Summary

Balfour Beatty is seeking an Employment Attorney to provide expert legal advice and support on a wide range of labor employment-related matters, ensuring compliance with all applicable laws and regulations for the Balfour Beatty plc subsidiary business units in the United States. This role works to address labor and employment issues, mitigate risks, and foster a positive work environment.

This is a remote position that also involves in-person teamwork. The candidate should live near a Balfour Beatty U.S. office and be open to frequent travel (approximately 25%).


Professional Skills

Legal Compliance:



  • Monitor and ensure compliance with federal, state, and local labor and employment laws and regulations.
  • Conduct regular audits of company policies and procedures to ensure legal compliance.
  • Stay updated on changes in labor and employment law and advise management on necessary adjustments.


Policy Development:



  • Assist in the creation, implementation, and enforcement of company policies and procedures related to labor and employment law.
  • Review and update policies, procedures, employee handbooks and manuals to reflect current laws and best practices.
  • Provide guidance on the development of workplace policies that promote a positive and inclusive work environment.



Dispute Resolution:



  • Manage and resolve labor and employment disputes, including handling employee grievances.
  • Represent the company in mediations, arbitrations, and other legal proceedings where appropriate.
  • Develop strategies to minimize litigation risks and manage external counsel when necessary.


Investigations:



  • Work with the Legal and Ethics & Compliance Departments for each business unit to conduct investigations related to labor and employment matters.
  • Make recommendations for discipline and improvements to policies, procedures and controls based on investigation findings.


Advisory Role:



  • Work with Provide legal advice and guidance on a wide range of labor and employment issues, including hiring, termination, discrimination, harassment, wage and hour laws, and employee benefits.
  • Advise on the legal implications of labor and employment decisions and actions.


Training:



  • Develop and deliver training programs for management and employees on labor and employment law topics and best practices.
  • Conduct workshops and seminars on topics such as anti-discrimination, harassment prevention, and workplace ethics, in partnership with the ethics and compliance departments of each business unit.
  • Create training materials and resources to educate employees on their rights and responsibilities.


Risk Management:



  • Identify and mitigate potential legal risks related to labor and employment practices.
  • Coordinate with the Ethics & Compliance and Legal Departments to conduct risk assessments and develop proactive measures to prevent legal issues.
  • Collaborate with HR and management to implement risk management strategies.


Litigation Support:



  • Collaborate with and manage external counsel on employment litigation matters.
  • Manage the company's response to legal claims, including preparing legal documents and evidence.
  • Represent the company in court proceedings and administrative hearings as needed. It is anticipated that most litigation matters will be handled by outside counsel.

Working Conditions

The majority of work is completed in an office setting with intermittent sitting, standing, and walking. Frequent travel when needed.



Minimum Requirements

  • Education: Juris Doctor (JD) degree from an accredited law school.
  • Licensure: Active license to practice law in at least the state of residence.
  • Experience: Minimum of 8 years of experience in employment law, preferably in an in-house legal department or law firm.
  • Skills: Strong knowledge of federal, state, and local labor and employment laws and regulations. Excellent analytical, negotiation, and communication skills. Ability to work independently and as part of a team. Strong organizational skills and attention to detail.



Preferred Experience and Education



  • Experience in a corporate legal department.
  • Certification in labor and employment law or related fields from a State Bar or State Board for attorney certification.
  • Proven track record of successfully managing labor and employment disputes and litigation.
  • Experience with Collective Bargaining Agreements and Project Labor Agreements.
