Deputy General Counsel

The Massachusetts Gaming Commission seeks to hire a Deputy General Counsel. This position serves the Commission as a member of the agency's legal department under the supervision of the General Counsel. As part of the legal team, a Deputy General Counsel will be called upon to offer legal advice and strategy on a wide variety of matters throughout the agency pertaining to the regulatory oversight of casino gaming, sports wagering, horse racing, and other matters under the Commission's purview and to offer leadership, mentoring, and support to attorneys in the legal department. Unique issues may arise daily that require careful research, thoughtful analysis, and response to which the person serving in this capacity will be expected to diligently attend. Ultimately, a Deputy General Counsel assists in helping to ensure that the legal team provides sound, timely, and ethical legal advice to all Commissioners and agency staff.

Specific duties and responsibilities may include, but not be limited to, the following:

• Draft, amend, and interpret agency regulations, rules, and policies;
• Interpret and provide legal advice on statutes and regulations related to agency affairs including, for example, the Open Meeting Law and Public Records Law, and assist with associated compliance;
• Advise the Commissioners and agency staff, including all divisions, on matters related to G.L. c.23K, G.L. c. 23N, G.L. c.128A, and 205 CMR;
• Advise the Commissioners and agency staff on matters related to the Conflict-of-Interest Law and the Commission's Enhanced Code of Ethics;
• Coordinate hearing program including assigning hearing officers to appeals, conducting initial evaluation of appeals for sufficiency, overseeing clerk duties, and serving as counsel to Commission for appeals;
• Respond to requests for public records and appeals in accordance with the Public Records Law;
• Manage regulation promulgation process;
• Manage meeting minutes program, including drafting and reviewing drafts;
• Draft, negotiate, and review contracts, MOUs, grants, and similar agreements;
• Oversee the legal department's involvement in the procurement process;
• Oversee handling of litigation pending against the Commission and coordinate with outside counsel to ensure that the Commission is apprised of the status of cases, and presented with issues requiring strategic decision making;
• Participate in human resources and personnel matters;
• Coordinate Special Assistant AG process, as required; and
• Other duties as assigned.

• Demonstrated capacity for sound legal analysis, legal reasoning, problem solving, and legal research and writing skills;
• Experience with administrative law, government/legislative affairs, and/or litigation;
• An even temperament, principled judgment, and a positive outlook; and
• Strong oral and written communication skills.

Education and Experience:

• A Juris Doctor degree from an accredited law school, and a current license to practice law in Massachusetts.
• At least eight years of experience working in a law firm, corporate in-house legal department, governmental agency, or similar setting.
• Experience in employment/labor law a plus.

The MGC offers a hybrid work environment and requires staff to work at least two days in the Boston Office. Based on business needs, additional in-office days may be required.

Salary is commensurate with experience.

The successful candidate must pass an extensive background check conducted by the Massachusetts State Police. It includes a full credit check, CORI (Criminal Offender Record Information), fingerprinting, drug test, reference checks, review of IRS Income Tax Transcripts for the last four years, and a Certificate of Good Standing from the Massachusetts Dept. of Revenue (DOR).

The Massachusetts Gaming Commission is responsible for the implementation of the expanded gaming law (Chapter 194 of the Acts of 2011) and regulatory oversight of G.L. chapter 23K (casino gaming), chapter 23N (sports wagering), and chapter 128A (horse racing). Under these laws, the Commission is tasked with establishing a regulatory framework for the solicitation, licensing, taxation, and oversight of a maximum of three casino licenses and one slots parlor only license, the provision of in-person and digital sports wagering, and the live and simulcasting of horse racing in Massachusetts.
